The evolution of the jurisprudential debate about non pecuniary damages seems to be an endless story. The apex of the Corte di cassazione, the Sezioni unite, has repeatedly tried to unify the award of these damages, denouncinfg on the one hand the risk of duplication and, on the other, the threat of a floodgate argument in the vein of damages awarded for marginal discomfort. Nonetheless, as witnessed by the opinion examined in this comment, the proliferation of award items keeps operating.
