The article critically examines judgment No. 18583/2025 of the Italian Court of Cassation concerning the time limit within which the Italian Data Protection Authority must notify an alleged infringement following its preliminary investigation. The Court held that this phase is external and merely preparatory to the sanctioning proceedings proper and that, accordingly, the applicable time limit is directory rather than mandatory. After reconstructing the relevant regulatory framework and divergent case law, the article challenges this distinction. It argues that the enforcement process is functionally unitary and that allowing the Authority to determine, through an internal and non-transparent assessment, when an infringement has been sufficiently established risks rendering procedural time limits ineffective. Such an approach undermines legal certainty, legitimate expectations, the adversarial principle, the right of defence, and the reasonable duration of proceedings. The article therefore calls for an objectively verifiable dies a quo and for regulatory reform reconciling effective enforcement with constitutional, ECHR, and EU law safeguards.
