Autonomia universitaria tra formalismo regolamentare e giudizi qualitativi

The ruling by the Regional Administrative Court of Lazio, Rome, provides an opportunity to reflect on the relationship between the regulatory autonomy of universities and the qualitative nature of academic assessment. The Court overturned the exclusion of a doctoral student from Universitas Mercatorum, highlighting the illegality of the measure due to the absence of predetermined evaluation criteria, lack of formal checks and violation of the right to participate in the proceedings, but at the same time emphasised the need for a substantive assessment of the student’s scientific maturity. There is therefore a strong tension between the formalisation of rules and the physiological “elasticity” of the university system. The case reveals how a lack of regulation can result in the arbitrary exercise of discretion, but also shows the limits of overly mechanical regulation.

La sentenza del T.A.R. Lazio,Roma, Sez.III-ter, 7 luglio 2025, n. 14126, offre lo spunto per riflettere sul rapporto tra autonomia normativa degli Atenei e natura qualitativa della valutazione accademica. Il T.A.R. annulla l’esclusione di un dottorando dall’Universitas Mercatorum, evidenziando l’illegittimità del provvedimento per assenza di criteri valutativi predeterminati, mancanza di verifiche formali e violazione del diritto alla partecipazione procedimentale, ma richiama nello stesso tempo la necessità di un giudizio sostanziale sulla maturità scientifica dello studente. Emerge, dunque, una forte tensione tra formalizzazione delle regole e fisiologica “elasticità” dell’ordinamento universitario. Il caso rivela come la mancata regolazione possa tradursi in esercizio arbitrario della discrezionalità, ma mostra anche i limiti di una normazione eccessivamente meccanicistica.
