This comment focuses on two intertwined decisions of the Italian Constitutional Court (the court): Order 14 January 2021, No.4, and Judgment 12 March 2021, No.37. The relevance of such decisions resides in two main issues: in Judgment No.37/2021, for the first time, the court directly addressed the allocation of competences between the state and regions in the context of the global COVID-19 pandemic, whereas in Order No.4/2021, for the first time as well, the court exercised its power of suspension of the legal effects of a law.
