The victim of a traffic accident, one of Jehovah's Witnesses, refuses the blood transfusion which, with reliable probability, would have saved his life. The Court of Cassation, reversing the judgment on the merits, excludes that said refusal involves an exposure to risk, to be assessed as a causal factor concurrent with the conduct of the offender (with the effect of reducing the amount of damages the injuring party is to pay), by leveraging on a dogmatic system that equates religious choice with innocent human conduct, this conduct, free as long as it involves the legal-patrimonial sphere of those who carry it out, can be considered responsive to the canon of reasonableness, even when the price of the "gift" of faith must fall on a third party, albeit the injurer...
