The syntagma of “judicial protection” advises for a better analysis to preliminarily make the decomposition between right and action, since there are different degrees and forms of their mutual autonomy. Their recomposition in the judicial protection lies in that: it is in any case possible to achieve the ascertainment of a right, even without promoting an action. In the end, a declaratory judgement wherever a subjective right is given appears to be acquirable, even where no action of any kind is (ever, any more or not yet) given.

Abstract
