Article 11 of the Italian Constitution was originally intended to guarantee Italy's membership of the new international organisations that were being created in the post-war period. However, an analysis of the intention of the constituent, as well as of the constitutional interpretation in recent years and even of the process of integration into the European Union itself, offers us a broader reading of the function of this article. It is therefore configured as a "European super-clause". In other words, through it, the European Union is constituted as an indispensable element within Italian constitutionalism. According to this analysis, therefore, a possible exit of Italy from the European Union (Italexit) would be in direct conflict with the current constitutional text and would therefore require a new Constitution

Abstract

Article 11 of the Italian Constitution was originally intended to guarantee Italy's membership of the new international organisations that were being created in the post-war period. However, an analysis of the intention of the constituent, as well as of the constitutional interpretation in recent years and even of the process of integration into the European Union itself, offers us a broader reading of the function of this article. El artículo 11 de la Constitución italiana surge en origen para garantizar la pertenencia de Italia a las nuevas organizaciones internacionales que se estaban creando en el marco de la posguerra. Sin embargo, el análisis de la intención del constituyente, así como de la interpretación constitucional en estos años e incluso del propio proceso de integración en la Unión Europea nos ofrece una lectura más amplia de la función de este artículo. Se configura, por tanto, como una “superclausula europea”. Es decir, a través del mismo la Unión Europea se constituye como un elemento indispensable dentro del constitucionalismo italiano. De acuerdo con este análisis, por tanto, una posible salida de Italia de la Unión Europea (Italexit) supondría un conflicto directo con el actual texto constitucional y, por tanto, haría necesaria una nueva Constitución.
