Prenuptial agreements are recognised and regulated in several common law and civil law legal systems, but not in the Italian legal system where case law has traditionally considered them void. The issue has recently moved to the centre of the debate following some openings of the Italian Supreme Court and the recent reform proposals aimed at regulating prenuptial agreements. The aim of the investigation is the analysis, in the light of the most recent developments of the relational contract theory and the feminist relational contract theory, of the current expansion of private ordering in the field of family law and the legal framework applicable to prenuptial agreements. In particular, in relation to this latter area of investigation, the rationale and scope of possible limits to private ordering will be assessed, focusing primarily on the judicial control on the content of the contract, which is intended as a suitable tool to better protect the instances and peculiarities of such agreements, traditionally placed between the “status” and the “market”.
Gli accordi prematrimoniali sono riconosciuti e regolamentati in diversi ordinamenti giuridici di common law e civil law, ma non nell’ordinamento italiano nel quale la giurisprudenza ne ha tradizionalmente riconosciuto la nullità. Il tema è recentemente tornato al centro del dibattito a seguito di alcune aperture della corte di legittimità e delle recenti proposte di riforma volte a disciplinare gli accordi anticipati in vista del divorzio. Oggetto d’indagine è l’analisi, alla luce delle piú recenti evoluzioni della teoria dei relational contract e della feminist relational contract theory, dell’attuale espansione dell’autonomia privata nell’ambito dei negozi giuridici familiari ed il quadro di regole ad essi applicabili. In particolare, in relazione a quest’ultima area di indagine, si valuteranno ratio e portata di eventuali limiti all’autonomia privata incardinati in primis dal controllo giudiziale sul contenuto del contratto, inteso quale strumento idoneo a tutelare al meglio le istanze e le specificità di tali accordi, tradizionalmente collocati tra “status” e “mercato”.
