Defining the scope of a given legislative intervention is fundamental to understand a specific regulation. The clarification of what is meant by “public art” and what (if different) is meant by “art in public buildings” turns out to be necessary to better reflect on the legal instruments to be adopted to ensure the proper development of these two realities. Defining the boundaries of these two categories embedded in the broader definition of “Art and Public Space,” and then identifying their respective normative references is the intent of this brief paper. It will be analyzed how the two categories of regulatory intervention enacted to support “public art” and “art in public buildings” turn out to be autonomous and distinct both in their subject matter, as well as purposes pursued and, finally, in their implementation tools. The need for such a taxonomy appears necessary mainly to better clarify what legislative solutions and regulatory instruments can be proposed and implemented to regulate each specific public intervention.
