Nuova finanza e concordato preventivo

The work focuses several juridical issues arising from the necessity of new financing in turn-around processes and related constraints raised by the special discipline of crisis introduced in Italy. The paper aims at demonstrating the intention of Italian Legislator to penalize from that point of view late solutions of consolidated crisis in favor of promptly negotiating debt among the parties in not-judicial context.
