L'universale della causalità

Mauro Orlandi deals with the structure of norms. Starting from the command- obedience binomial, his analysis delves into the etiological essence of the phenomenon in order to illuminate the concept of legal causality as a transcendental scheme. Drawing on the great masters - from Hans Kelsen to Natalino Irti, from Angelo Falzea to Franco Cordero - the author oscillates within a dialectic of opposites, between the world of reality and the world of ideas, the world of being and the world of ought. This work ranges the nature of duty to an examination of the logical structure of the rule as a hypothetical judgment, and proposes an urgent clarification of the absolute irreducibility between natural and legal causality, for the edification of a universal category.

Mauro Orlandi muove dalla struttura della norma. Dal binomio comando-obbedienza verso l’essenza eziologica del fenomeno, scrutinando il concetto di causalità giuridica quale schema trascendentale. Attraverso la grande letteratura - da Hans Kelsen a Natalino Irti, da Angelo Falzea a Franco Cordero – l’indagine si sviluppa in una dialettica degli opposti, tra mondo empirico e mondo ideale; essere e dover essere. Passando dalla natura del dovere alla struttura logica della norma come giudizio ipotetico, si giunge a superare la diffusa idea dell’ontologica irriducibilità tra causalità naturale e c. giuridica; verso la costruzione di una categoria universale.
