Istituzione e linguaggio

La istituzione si rivela entità che si organizza, dura nel tempo, e vincola i singoli individui. In questo ripetersi e consolidarsi, si costituisce in uso come pratica linguistica, che i parlanti avvertono come normativa (è la opinio juris ac necessitatis della consuetudine giuridica): dove non c’è costrizione, ma consapevolezza dei significati utilizzati e utilizzabili nel rapporto comunicativo. Nella logica centripeta che avvicina istituzione e significazione, oso ripercorrere il movimento degli studiosi, rovesciandone il senso: il diritto è solo linguaggio. Institution turns out to be an entity that organizes itself, lasts over time, and binds individuals. In this repetition and consolidation, it constitutes itself as a linguistic practice, which speakers perceive as normative (it is the opinio juris ac necessitatis of legal custom), where there is no constraint, but awareness of the meanings used and usable in the communicative relationship. In the centripetal logic that brings together institution and signification, I dare to retrace the traditional doctrine, reversing its meaning: “ius” is only language.
