Le concessioni demaniali marittime: dalle sentenze dell'Adunanza plenaria al percorso di riforma. Punti critici e spunti di riflessione

For decades, the “history” of state-owned maritime concessions has been characterized by an accentuated complexity on a legal level. In fact, the matter has been affected by regulatory reforms, national and European jurisprudential decisions, as well as by interventions by the European Commission. In line with this jagged framework, but with the aim of putting an end to it, the Plenary Meeting of the Council of State was recently pronounced and an amendment to the draft law on competition was adopted by the Council of Ministers. These actions, certainly relevant and destined to produce a great impact, nevertheless lend themselves to certain criticisms and raise old and new questions, adding other pieces to a “story” that is not over yet.
