The Italian law transposing the Directive 2019/790/EU amended Art. 44 of the Copyright Act, the Italian provision that identifies the authors of the cinematographic work, adding the translator. This article argues that this legislative amendment is doubly unconstitutional, either for violation of the delegation law, and for unjust discriminatory treatment. It suggests that the Italian legislator would amend this provision based on the solution in force in the French system.

Abstract
The Italian law transposing the Directive 2019/790/EU amended Art. 44 of the Copyright Act, the Italian provision that identifies the authors of the cinematographic work, adding the translator. This article argues that this legislative amendment is doubly unconstitutional, either for violation of the delegation law, and for unjust discriminatory treatment. It suggests that the Italian legislator would amend this provision based on the solution in force in the French system.File | Dimensione | Formato | |
