The paper aims to analyse the concept of stability in electoral matters. The Venice Commission (through the Code of Good Practice in Electoral Matters) and judgments of the European Court of Human Rights developed the principle to ensure “a certain stability” in electoral legislation in order to avoid party ma-nipulation and guarantee the effectiveness of the right to vote. The Italian case appears to be a particularity: in the last thirty years electoral law has changed frequently, also due to the judgements of the Constitutional Court and referendum. The analysis will concern also the protections provided for electoral stability in the various European constitutions.
