The article analyses how the legislative function of Parliament has been transformed during the Brexit process, highlighting, on the one hand, elements of continuity and discontinuity compared to the pre-existing procedures, in particular with regard to the relationship between the Parliament and the Government, the success of private members bills and the role of the House of Lords; on the other, the staggering growth of the Executive’s rule-making powers as a consequence of the wide delegation conferred to modify and repeal retained EU law. Finally, it deals with the controversial repeal of the Fixed Term Parliaments Act 2011 as a case of Parliament’s self-disempowerment by law.
