La Brexit in Italia: le misure interne di governo e parlamento

The article aims at providing an account of the measures taken by our national constitutional bodies in relation to Brexit, especially with regard to an hypothetical no deal british withdrawal from the EU. Therefore, the decrees-law adopted by the government, mainly decree-law n. 22/2019, and the issue of “postponed effectiveness” are considered. Moreover, the parliamentary scrutiny over the european negotiations with UK and the checks on national executive are taken into account. It is then observed that art. 50 TEU does not foresee the direct involvement of national Parliaments and both the Whitdrawal Agreement and the following TCA were ratified as Eu-only agreements. Nevertheless, the role of European Parliament during the path to Brexit (also beyond what formally provided by art. 50) would seem to outweigh the marginalisation of national Parliaments in the perspective of integration between european and national forms of government.
