The paper is aimed at scrutinizing the fundamental rules applicable to the open banking and the provisions on innovative payment services (account information service and payment initiation service), with specific reference to the access to account rule, as outlined by Directive 2366/2015 (PSD2) and by the national transposition provisions. After examining the main technical solutions adopted by the Regulatory Technical Standards in order to guarantee effective access to payment account data to third parties, the possibility of considering payment accounts data as digital commodites is assessed considering whether the rules on the processing of personal data set out in Regulation 679/2016 (GDPR) and in PSD2 are in conflict with the free marketability of bank accounts data.
Il contributo è volto ad analizzare i tratti caratterizzanti del cd. open banking e della disciplina dei servizi di pagamento innovativi (account information service e payment initiation service), con specifico riferimento alla access to account rule, come delineata dalla Direttiva 2366/2015 (PSD2) e dalle disposizioni nazionali di recepimento. Evidenziate le principali soluzioni tecniche adottate dai Regulatory Technical Standards al fine di garantire l’effettività dell’accesso delle terze parti ai dati relativi ai conti di pagamento, viene esaminata la possibilità di considerare i dati bancari alla stregua di digital commodities valutando se la disciplina sul trattamento dei dati personali recata dal Regolamento 679/2016 (GDPR) e dalla PSD2 si ponga in contrasto con la libera commerciabilità di tali dati.
