The paper focuses on the compatibility of the Italian tax system with compliance to the European principle of ne bis in idem. For this purpose, a “biphasic” approach is adopted. At first, after having retraced the main developments of both European and constitutional case law, the Authors verify if, at a general level, the Italian tax system is compliant with the ne bis in idem principle. Then, the analysis shifts to the way in which the Supreme Court has implemented the ne bis in idem principle in its case law, remarking limits and evolutionary perspectives also in the light of recent legislative amendments.

Il contributo analizza la compatibilità dell’ordinamento tributario italiano rispetto al principio del be bis in idem di matrice europea. A tal fine, viene adottato un approccio bifasico. Dapprima, dopo aver ripercorso le principali tappe evolutive registratesi nella giurisprudenza europea e costituzionale, viene verificato se nel nostro ordinamento possano dirsi presenti le condizioni che consentano, almeno ad un livello generale ed astratto, il rispetto del divieto in esame. In un secondo momento, l’analisi viene rapportata alla concreta attuazione che il divieto di bis in idem ha ricevuto nella giurisprudenza tributaria di legittimità, evidenziandone limiti e prospettive evolutive anche alla luce delle recenti modifiche normative.

Abstract
