The essay – conceived for the collected studies in honor of Franco Pizzetti – aims at showing how the Italian Constitutional Court, in a series of judgments on the relationship between domestic law and European Union law issued between the end of 2017 and the first half of 2019 (nos. 269/2017; 20/2019; 63/2019; 117/2019), is progressively adapting its case-law to the needs that the existence of a "net" system suggests. The objective is to underline that the choice, originally made by the Constitutional Court and declared in the order no. 536 of 1995, in the sense of renouncing an explicit dialogue with the Court of Justice of the European Union through the instrument of the preliminary reference, proved to be a mistake. And that the Constitutional Court itself, starting from 2008 and then even more clearly with the "Taricco saga" and its sequel, has understood the mistake made and is now trying to re-enter the inter-judicial dialogue aimed at protecting fundamental rights in the European Union, without contradicting the principles affirmed by the fundamental judgment no. 170/1984.
