The new Senate in the legislative process The essay examines how the legislative function is provided in the text of the constitutional reform published in the Official Journal n. 88 on 15 April 2016, mainly adopting the viewpoint of the new Senate’s powers. After highlighting, in the foreword, the difficulties of reforming a bicameral system while it is in motion and the significant role that the new Senate could potentially play, the essay analysis the two main fundamental options that inspire the constitutional reform: on the one side, the decision not to link the articulation of legislative procedures with the distribution of legislative competences between State and Regions: on the other side, the provision of an intervention of the Senate, either mandatory or upon request, on all the legislative bills, requiring, to overcome it, a new deliberation by the Chamber. Later on, the essay deals with the features of equal bicameral laws and the clause that protects their specific object: its is argued that they are a “numerus clausus” of laws regarding the legal framework, very similar to “organic laws”. The legislative process with the predominance of the Chamber, which represents the ordinary legislative process, is then examined, including its two main variations: that is, the laws implementing the “supremacy clause” and those related to the budget. In its final part, the essay analyses the provision regarding the agreements between the Speakers of the Houses, called upon to define potential overlappings between the legislative processes and ends underlining how many crucial options are left to the rules of procedures of the two Houses.

Il contributo esamina la disciplina della funzione legislativa contenuta nel testo della legge costituzionale pubblicato sulla Gazzetta Ufficiale n. 88 del 15 aprile 2016, ponendosi soprattutto nella prospettiva dei poteri del nuovo Senato. Dopo aver sottolineato, in premessa, le difficoltà di riformare un bicameralismo “in corsa” e il notevole ruolo che il nuovo Senato si trova potenzialmente a giocare, ci si sofferma sulle due scelte di fondo cui si ispira, riguardo alla funzione legislativa, la riforma costituzionale: da un lato, la decisione di non ancorare in alcun modo la distinzione dei procedimenti legislativi al riparto delle materie tra Stato e Regioni; dall’altro, il consentire un intervento del Senato (obbligatorio o possibile) su tutti i progetti di legge, richiedendo, nel caso, una nuova deliberazione della Camera, per superarlo. Successivamente, ci si sofferma sulle caratteristiche delle leggi bicamerali paritarie, e in particolare sulla clausola posta a tutela del loro oggetto proprio: sostendendosi che si tratti di un numerus clausus di leggi di contenuto ordinamentale, per molti versi assimilabili a vere e proprie “leggi organiche”. Si esamina poi il procedimento legislativo “a prevalenza Camera”, che rappresenta il procedimento legislativo ordinario, con le due principali varianti: ossia, le leggi attuative della clausola di supremazia e quelle in materie di bilancio. Infine, il contributo analizza la disposizione che rimette alle intese tra i due Presidenti delle Camere la definizione dei conflitti tra i diversi procedimenti legislativi delineati nel testo e si conclude rilevando quante opzioni cruciali siano rimesse ai regolamenti delle due Camere.
