Article 1284 of the Italian Civil Code has been reshaped with the clear goal of contributing to disgorge the heavy backlog of the judicial system. The underlying intent is unobjectionable (by increasing the costs of judicial resistence, it aims at neutralizing the advantages the late debtor unfairly derives from long-lasting legal proceedings), but the tool resorted to -increasing the legal interest rate across the board after the one adopted by the special statute regulating late payments in commercial transactions. - is hardly useful to the pursued outcome, whereas it turns out to be likely punitive toward people seeking good faith access to justice under conditions of uncertainty.
