La forma di governo dell’Unione, dopo le elezioni europee del maggio 2019

The contribution aims to assess the effects of the 2019 European Parliament elections and the formation of the Commission chaired by Ursula von der Leyen on the structure of the European Union's form of government, and in particular, to use the words of the Constitutional Court, on its "transformation in a parliamentary sense" (judgment no. 239/2018). It is maintained that the failure of the Spitzenkandidaten constitutional convention, contrarily to what it has been often argued, has not interrupted or weakened at all such transformation, which rather has undergone an acceleration, albeit at the cost of tacking – within the many variations that parliamentary regimes they know, in Europe but not only – towards a model further away from the so called "premiership" and, instead, closer to a properly parliamentary-consensual form of government. Although with all the adaptations that derive from the specific characteristics of the European Union, and in particular from the necessary intertwining with the forms of government of each of Member State.
